I go through an Evidence essay from the California Bar Exam and set up the issues using “issue checking.” Once you set up the issues, you're halfway home free.
This is in federal court, so we don't use any California law in this example. UBE folks looking for MEE help can also benefit from this discussion.
I used the phrase “issue spotting” in the title to get your attention, but we don't use the s-word (“spotting”) around here. Rather, we say “issue checking.”
