In this video, we discuss the rising number of cheque bounce (Section 138 NI Act) cases in India and the landmark Supreme Court judgment in Sanjabij Tari v. Kishore S. Borcar Decided on 25 September 2025. This judgment aims to speed up disposal of cheque bounce cases, reduce pendency, promote settlement, and introduce modern methods of serving summons.
Key Highlights:
• Massive pendency: Delhi – 6,50,283 cases; Mumbai – 1,17,190; Kolkata – 2,65,985 (as per NJDG).
• Supreme Court clarifies that punishment in cheque bounce cases is not retributive but to secure payment to the complainant.
• New compounding guidelines effective from 1 November 2025:
– 0% cost if cheque amount paid before defence evidence.
– 5% cost if paid after evidence but before judgment.
– 7.5% cost before Sessions Court/High Court.
– 10% cost if paid before Supreme Court.
• Summons can now be served via email, mobile, or WhatsApp; complainant must submit digital details with an affidavit.
• Cash transactions above Rs. 20,000 held as legally enforceable debt.
• Courts encouraged to use ADR, interim compensation (Section 143-A), and dashboards for monitoring pendency.
• High Courts restricted from re-evaluating evidence in revision unless there is jurisdictional error.
This judgment is a major step toward faster justice and reducing court burden. The earlier the accused settles, the more benefit he receives.
