Section 190(2) is a provision within The Motor Vehicles Act, 1988 (MVA) of India, which makes it an offense to drive or allow a vehicle to be driven in a public place if it violates the prescribed standards for control of noise and air pollution.

A first offense under Section 190(2) can result in imprisonment up to three months, a fine up to ₹10,000, or both, and disqualification of the driving license for three months. Subsequent offenses can lead to imprisonment up to six months, a fine up to ₹10,000, or both.
Specific Violations Covered
This section is often applied for driving without a valid Pollution Under Control (PUC) certificate or using a vehicle with a modified silencer or pressure horn that exceeds noise limits. Both the driver and owner can be held responsible if the vehicle is operated in a non-compliant state
