What Is the CAA?
The CAA was passed by the Indian Parliament on 11 December 2019 and came into effect from 10 January 2020.
It amends the Citizenship Act of 1955, creating a new route to citizenship for certain persecuted religious minorities.
Who Is Eligible Under the CAA?
The act makes Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians from Afghanistan, Bangladesh, and Pakistan eligible for Indian citizenship, provided they entered India on or before December 31, 2014.
The reason given is that these groups may have faced religious persecution in their home countries.
Importantly, Muslims are not included in this provision.
What Are the Key Changes Introduced?
1. Residency Requirement Relaxed
For those eligible under the CAA, the required period of stay in India before applying for citizenship is reduced.
Earlier it was 11 years, but under CAA it is cut to 5 years.
2. Geographical Exemptions
Certain tribal areas in the Northeast (specifically in Assam, Meghalaya, Mizoram, and Tripura) are exempted from the CAA’s jurisdiction.
Areas under the Inner Line Permit (ILP) system are also exempted.
3. Fast-Track Citizenship
The Act provides a more accelerated pathway for the eligible migrants to become Indian citizens.
The government has also issued rules (CAA rules) specifying how to apply, what documents are needed, and how claims will be processed.
