Despite filing complaints with the DC, police, and senior officers, no action was taken. While admitting that some cases are pending against him, the petitioner argued this gives no one the right to seize his land. The Court questioned how such mining was allowed without royalty or legal sanction, and though the state said it had stopped the activity and warned the respondent, the judge found this inadequate. Holding that accountability must be fixed, the Court issued notices to the DC and police, warning that failure to act could result in an FIR against the DC.
