The doctrine of prescription allows a user, having complied with conditions set forth by court or statute, to obtain an easement against the record owner’s wishes. Often surveyors are confronted with evidence of adverse use. This seminar will discuss how the surveyor can recognize possible adverse use, deals with adverse use, and reports possible adverse use.
