I am going to discuss whether this is the ultimate strategy for fathers? I am Philip Kedge the director of the brilliant McKenzie Friend Network where all my views and opinions are entirely my own and nothing I say represents legal advice.

So, this may be controversial but, for those who follow me will know that when it comes to our broken, dystopian and incomprehensible family court system which institutionally throws fathers under the family court bus, I don’t shy away from controversy. So, today I am going to explore whether we can flip that scenario and put the Dads back on the front foot.

We know that fathers who leave the family home give up the keys and the castle, the keys being the children and the castle being the home. They are then totally disadvantaged, at the mercy of the resident parent mother who then makes all too often spurious allegation based on hate, manipulating the family court to destroy the relationship between father and the children.

So, what happens if the father doesn’t leave the family home, but stays until all the issues of divorce, child arrangements and financial settlements are resolved. Well, arguably, they place themselves in a far far stronger position. So, what are their potential strategies to adopt in that situation?

5. Firstly, to be like a Budhest Monk, the only way in which the mummy can get them out is to have them arrested or to apply for an occupation order based on abuse and harm. So, you have to be a saint, never raise your voice in anger, never slam a door and never send a mean or unsavory text.

6. The next option is to then, whilst in the house, behaving like a bhudist monk, immediately apply for a child arrangements order and a prohibitive steps order to prevent the mummy leaving with the children. She can move out, but can’t take the children with her.

7 Thirdly, If the mummy ever raises her voice, calls you a dickhead, or engages in abuse, you call the police and get her removed.

8. The playing field is now levelled and that I would suggest that that places you in a very strong negotiating position to then go to mediation to resolve child arrangements and your finances.
