Time Allowance for Study, Teaching, and Mentoring

Prisoners can receive a reduction of up to 15 days off their sentence for each month they spend earning educational qualifications or serving as teachers/mentors while incarcerated.

Warden
The Warden is the head of district, municipal, and city jails under the BJMP, or provincial and sub-provincial jails under the Provincial Governor's Office.

RULE IV: Benefits of Credit for Preventive Imprisonment (CP)

*Section 1: Duty to Inform Detainees*
Authorities must inform detainees that their preventive imprisonment period will be deducted from their sentence as per Article 29 of the Revised Penal Code.

*Section 2: Eligibility*
Accused individuals who have undergone preventive imprisonment will receive credit for the full term or four-fifths (4/5) of their actual detention time, unless disqualified under Article 29 or subsequent sections.

*Section 3: Disqualifications*
Credit for preventive imprisonment does not apply to:
Recidivists.
Those previously convicted twice or more.
Those who failed to voluntarily surrender for sentence execution.

*Section 4: Full Credit Requirements*
Detainees get full credit for preventive imprisonment if they:
Voluntarily agree in writing to abide by the same rules as convicted prisoners.
Execute the agreement with counsel's assistance.

*Section 5: Partial Credit (Four-Fifths) Requirements*
Detainees receive four-fifths (4/5) credit if they:
Agree in writing not to abide by the same rules as convicted prisoners.
Have counsel's assistance.

*Section 6: Provisional Release*
Accused individuals will be released if they have undergone preventive imprisonment equal to the maximum sentence of their offense and their case is undecided, except for recidivists, habitual delinquents, escapees, and those charged with heinous crimes. For destierro penalties, release occurs after 30 days.

*Section 7: Good Conduct Time Allowance (GCTA)*
Qualified detainees for credit for preventive imprisonment can also avail themselves of good conduct time allowance as per Article 97 of the Revised Penal Code.

*Section 8: Reclusion Perpetua*
Credit for preventive imprisonment is deducted from a 30-year term when the imposable penalty is reclusion perpetua.

RULE V: Good Conduct Time Allowance (GCTA)

*Section 1: Eligibility*
Detention prisoners with good conduct and exemplary behavior.
Convicted prisoners with good conduct and exemplary behavior.

*Section 2: Deductions for Good Conduct*
20 days per month for the first two years.
23 days per month for the third to fifth years.
25 days per month from the sixth to the tenth years.
30 days per month for the eleventh and subsequent years.

Section 3: Management, Screening, and Evaluation Committee (MSEC)
MSEC evaluates and grants GCTA, STAL, and TASTM.
Membership includes a probation and parole officer, and if available, a psychologist and a social worker.

Section 4: Procedures for Granting GCTA
Considerations include rehabilitation program involvement, authorized work activities, and exemplary deeds.
MSEC makes recommendations, which are then approved, disapproved, or returned for correction by the appropriate official.

Section 5: Computer Template and Manual
An automated template and a written computation table are used to monitor and calculate time allowances.

Section 6: Time Allowance for Study, Teaching, and Mentoring (TASTM)
An additional deduction of 15 days per month for study, teaching, or mentoring.

Section 7: Procedures for Granting TASTM
Master list of eligible prisoners maintained.
MSEC monitors and certifies participation.

Section 8: Effect of Appeal
An appeal does not deprive an accused of time allowances.

RULE VI: Special Time Allowance for Loyalty (STAL)

Section 1: Deduction for Loyalty
One-fifth (1/5) deduction if a prisoner surrenders within 48 hours after a calamity proclamation.
Two-fifths (2/5) deduction if the prisoner remains in confinement during a calamity.
