Joseph Malanji Convicted & Sentenced
Not me stretching a situation to teach a lesson in due diligence 😂
The lesson we learn today is in diligence. More than just having legal counsel do it, best to follow what they the reccomend.
Not to say Mr. Malanji did not follow, but it it can serve as an example of what could potentially happen to someone. That & also you could lose a lot of money , lose assets aswell.
Due diligence is simply an investigation undertaken before entering a business agreement or contract, or taking another action with a specific standard of care. It involves a thorough examination of a business's legal, financial, economic, and operational aspects to identify risks, liabilities, and validate information, ultimately informing a decision about the arrangement.
Don’t call lawyers to put out fires, call them to prevent fires.
Brief details are that are reported on ZNBC Today Facebook Page are that:
(By Alice Lubasi)
Former Foreign Affairs Minister Joseph Malanji has been convicted on seven counts of possession of property suspected to be proceeds of crime.
Mr. Malanji was found guilty of unlawfully possessing several high-value assets, including a Bell 430 helicopter, a Bell 206 Jet and three residential properties in Silverest.
The court has however acquitted Mr. Malanji on one count related to the Gibson Royal Hotel in Kitwe, ruling that the prosecution failed to prove the funds used to purchase the property were tainted.
In her judgment, Magistrate Wishimanga said the source of funds used to acquire the aircraft was not satisfactorily accounted for, and that the State had proved its case beyond reasonable doubt.
She further said although Mr. Malanji could afford some properties in Silverest through his known income sources, he failed to explain a portion of the funds used in the acquisitions, rendering them proceeds of crime.
During mitigation, defense lawyer Chandawire Nyimbiri told the court that Mr. Malanji was remorseful, a first-time offender, and therefore deserved maximum leniency in sentencing.
Mr. Malanji is jointly charged with former Secretary to the Treasury Fredson Yamba on allegations of possession of property suspected to be proceeds of crime and willful failure to follow procedure.
Magistrate Wishimanga also convicted Mr. Yamba on two counts of willful failure to follow procedure in the management of public funds.
The court found that Mr. YAMBA irregularly authorized the transfer of 100 and 8 million Kwacha to the Zambian Mission in Turkey for real estate procurement, in breach of established financial procedures.
Mr. Yamba's legal team appealed for a suspended sentence, arguing that his actions were in pursuit of government property acquisition, and that he personally did not benefit from the funds.
