SELF DEFENSE
Anyone who acts in defense of his person or rights, provided there is an unlawful aggression, reasonable necessity of the means to prevent or repel it and there is lack of sufficient provocation on the part of person defending himself. (Art 11)
DEFENSE OF A RELATIVE
Anyone who acts in the defense of the person or rights of his spouse, ascendant, descendant, brothers or sisters, legitimate, natural or adopted, or relatives by affinity in the same degree and those of consanguinity within the fourth civil degree. (Art11 par2)
The defense of the persons spouse first cousin is a defense of a stranger.
KINDS OF UNLAWFUL AGGRESSION
1. Actual
2. Imminent
The act of shouting back does not constitute either actual or imminent unlawful aggression because there is no physical force or weapon which may endanger life.
