Previously, we discussed 5 common examples of wage theft. Wage theft is any form of theft from an employee by the employer, and this can be tricky — there are a lot of ways that employers can, and DO commit wage theft every day,. It is important you are well versed in types of wage theft and know your rights in case you are one day a victim of wage theft by your employer. Today let's discuss 5 MORE examples of wage theft.
1) Some employers quietly and deliberately falsify time records to make it look like an employee has worked fewer hours than they really did.
2) Unlawful paycheck deductions. Blaming employees for a cash shortage that never occurred and withholding this from the employee's paycheck is an example of wage theft.
3) Handling tips in a way that takes them away from the employee. For example, an employer can NOT take a share of the pooled tips. A manager taking a cut of pooled wages is often wage theft. Tipped employees are the most common victims of wage theft.
4) Vehicle dealers and other commission-based businesses not ensuring that their employees receive at least the equivalent of minimum wage for each hour worked, is another common form of wage theft. Just because you work for a commission does NOT mean you should ever make less than minimum wage.
5) Some salaried employees are exempt from receiving overtime for extra hours they worked. However, overtime exception only applies if an employee is genuinely exempt. Employers will often claim an employee as exempt when they are not. Deliberately misclassifying employees to avoid paying overtime is another common example of wage theft.
