The UK Supreme Court has ruled that transgender women are not legally women under equality legislation, clarifying that the terms 'women' and 'sex' in Equality Act 2010 only refer to a biological woman and biological sex.
The judgment was successfully handed down on Wednesday, April 16, after a campaign group appealed a previous ruling that decided a trans woman with a gender recognition certificate (GRC) was protected from discrimination as a woman under the Act.
Deputy President of the Supreme Court, Lord Patrick Hodge said the ruling will not disadvantage trans people, but Amnesty International UK’s Chief Executive, Sacha Deshmukh, warned the decision could lead to further marginalisation.
