The Trump administration has just filed with the Supreme Court its most compelling argument yet for limiting birthright citizenship to the children born on US soil to American citizens and permanent resident aliens ONLY, and denying birthright citizenship to the children born on US soil to mere visa holders (tourist/student/work) and illegal invaders.

This argument is being made in defense of Trump’s Executive Order on birthright citizenship, which promises to deny citizenship documentation to persons born on US soil who do not properly qualify for birthright citizenship. That Executive Order has been stopped by the inferior federal courts, and is the legal question is now in front of the Supreme court.

Both Trump’s Executive Order and his most recent argument filed before SCOTUS do, of course, present the correct legal scope of birthright citizenship, as I have covered previously many times, but this most recent brief filed with SCOTUS is particularly rich in contemporaneous historical evidence of this proper understanding of that limited scope of birthright citizenship.
