Aggravated DWI Suspect Crashes Her Car Then Cannot Follow Instructions

SARATOGA SPRINGS, NY - At 11:41PM on April 2nd, 2020, a Saratoga Springs Police Officer investigated a crash between a moving vehicle and a truck parked on the side of the road on Eastern Ave. The driver of the vehicle is identified by a bystander and the officer began questioning her. The suspect struggled to answer questions and admitted to having one alcoholic beverage before attempting to drive home. The suspect was again questioned and her story became more confusing. The suspect claims she did not know how she hit the truck and when asked how much she had to drink, she claimed she had "two casamigos on the rocks... a couple of hours ago."

The suspect was then asked if she had taken any drugs, if she had any medical issues, or if she had any other reasons as to why she would be unable to perform field sobriety tests. During the horizontal gaze nystagmus test, the suspect struggled significantly to track the pen in any capacity, moved her head repeatedly, and displayed significant jerking in her eyes at maximum deviation. Next, the officer demonstrated the walk-and-turn test. After instructing the suspect exactly how to perform such a test, she was unable to follow any portion with any proficient. The suspect took four steps, turned 90°, and repeated the process until she was back in her starting position, but facing the opposite direction in which she had began. The officer then clearly demonstrated the one leg stand test. The suspect responded by walking forward in no clear direction nor began counting. The officer reexplained the test to the suspect in the same detail. The suspect began walking and counting in thousands before turning towards the officer and telling him that she had finished the test. The suspect repeatedly began asking, "was that not the test?" or to some effect.

Upon completion of the field sobriety test, the suspect registered a .26% breath alcohol content (BrAC) with a preliminary breath test and was immediately arrested for driving while intoxicated (DWI). While under arrest, the suspect asked if she was being transported to her car whereupon the officer answered she would be transported to the police station in his car. At the station, the suspect again registered the same BrAC. She was charged with aggravated driving while intoxicated (aggravated DWI, .18% BAC or greater in New York).
