What's the difference between a defense and an affirmative defense? If you're in law school - or just interested in how law works - you may have heard this term and wondered what the heck the lawyers were talking about. Why not just call it a defense? Affirmative defenses are defenses that negate the entire claim in a civil case, or negate the entire crime in a criminal case. And the defendant has the burden of proof.
