I am always polite.
I am always cordial.
Except when I'm not.
Except when someone pushes my buttons.
Except when someone turns nasty.
Except when someone intentionally tries to antagonize me or my client.
Then, I push back.
Sometimes in a polite, calm and measured way.
Sometimes in a sarcastic way.
Sometimes in a way that lets them know I won't be pushed around.
There are many cases where I have dealt with and worked with attorneys and been very friendly during a deposition. There are cases which started out polite and during the middle of questioning, it took a turn for the worse and got a bit antagonistic. Then, that might have continued later on during the deposition. And at the end of the case, we were pleasant as possible to each other, as if nothing unusual had happened during the deposition.
Can this happen?
Does it happen?
Is it unusual for this to occur during a deposition?
Yes, yes and no.
You see, lawyers are required to be professional, cordial and pleasant to each other and to the witnesses. There are court rules that govern the conduct of attorneys. As often happens during a deposition, disputes arise about the question that is being asked. Maybe the topic is off limits. Maybe the question is not articulate. Maybe the question points a finger at another doctor who has been sued. There could be many reasons why attorneys disagree during a deposition.
The question is whether it's possible, despite disagreements and verbal jousting during the deposition, you can still be pleasant and cordial at the end if it.
