Hamilton County prosecutor halts release of Kyle Plush probe results

CINCINNATI, Ohio (WKRC) - Hamilton County's prosecutor served the city of Cincinnati with a subpoena Wednesday morning for the investigation into Kyle Plush's death minutes before a meeting on the investigation's findings was set to begin. The meeting was canceled because the Grand Jury subpoena prevented the findings of the investigation from being discussed.
Prosecutor Joe Deters said he served the city with the subpoena after talking with the family of Kyle Plush Tuesday night. Cincinnati police met with the Plush family Tuesday to discuss the details of the investigation. Deters said he found out about surveillance video that his office had not yet reviewed. He said the Plushes were concerned that it showed the faces of students who walked past Kyle's van.
"They were worried that these kids would feel guilty that they could not find Kyle because they were so close and he said you can see their faces and we have not seen that yet," Deters said Wednesday.
Deters said his office also hadn't seen an administrative report from the sheriff's office. A deputy working an off-duty traffic detail had spoken with Officers Brazile and Osborn who responded to the scene. Deputy Doug Allen also looked for Kyle's van but didn't find it.
"There's nothing nefarious about this. There's no like criminal targets or anything. We just want to make sure we know everything that happened before we talk to the family next week," Deters said.
Two Cincinnati police officers were dispatched to Seven Hills School the day Kyle called 911. The original dispatch was for a woman stuck in a van who couldn't hear the operator. The van was possibly in the thrift store parking lot, according to the dispatch report. Information from Kyle's second 911 call was never passed along to the officers. The call taker told supervisors she couldn't hear anything on the line.
The Plush family has told council members they want changes made at the 911 center.
"The message I get from them is that they want the 911 call center fixed and that they want to make sure this doesn't impact any other family member," said Law and Public safety chair Christopher Smitherman.
Deters said his office's review of the investigation should be complete early next week. He said the subpoena doesn't guarantee the case will be presented to the Grand Jury. The Law and Public Safety Committee meeting can take place after Deters' review is complete.
