The Supreme court held that when a petition/appeal is not drafted by the advocate- on-record, the advocate-on-record who files it is entirely and wholly responsible to this Court. Therefore, when an advocate-on-record receives a draft of a petition appeal/counter-affidavit from any other advocate, it is his duty to go through the case papers and, thereafter, to carefully go through the petition/appeal/counter-affidavit to ascertain whether correct facts have been stated in the draft and whether all relevant documents are annexed to the petition/appeal/counter-affidavit. Therefore, it is his duty to be cautious and careful. His duty is to file proper proceedings and affidavits before this Court to assist the court in dispensing justice. He must always be fair to the Court and effectively assist the Court in deciding cases. The duty of the advocate-on-record does not end after filing a case or a counter. Even if the counsel appointed by him is not present, he must be ready with the case on law and facts and effectively assist the Court,
STATE OF UTTAR PRADESH & ORS. V. PRATYUSH RAWAT & ORS
A bench comprising Justices Dipankar Datta and Manmohan expressed concern over the High Court’s actions, stating that it amounted to an attempt to overreach the Supreme Court. The bench emphasized that the High Court should have waited for further directions rather than issuing fresh interim orders. The Court noted that such actions were neither warranted nor desirable under the circumstances and called for greater responsibility from the High Court in the future. The Supreme Court has strongly criticized the Allahabad High Court for issuing an interim order in a case related to a food distribution scheme for lactating mothers and young children, despite the matter already being under consideration by the apex court.
IN RE : ORDER DATED 27/01/2025 PASSED BY LOKPAL OF INDIA AND ANCILLIARY ISSUES
The Supreme Court of India has taken suo moto cognizance of the Lokpal's decision of January 27 on and stayed the Lokpal's decision that had held it has jurisdiction over high court judges. A bench of Justices BR Gavai, Surya Kant, and Abhay S Oka ordered, "Issue notice to the Union of India, the Registrar of Lokpal, and the complainant. The Registrar (Judicial) is directed to mask the identity of the complainant. Therefore, the impugned order shall remain stayed. We further direct the complainant not to disclose the name of the judge against whom the complaint has been filed."
