Motions to vacate are the way you ask a court to wipe out a judgment and start the case over. Usually when people talk about motions to vacate, they're talking about a motion based on some sort of excusable mistake by the defendant in failing to respond to a summons. But there's another kind of motion to vacate based on the court's lack of power to render judgment. This most often happens in sewer service cases, where the process server swears he or she served the summons on you, but lied. You have a remedy.
