This session addresses key ethical considerations when preparing witnesses for deposition and trial, exploring critical topics such as: Should a lawyer explain the law before asking the witness what happened? Should other evidence be revealed before asking a witness about their testimony? What are the differences between preparing a witness for deposition versus trial?
The panel also discusses the fine line between helping a witness communicate clearly and avoiding any influence that could lead to false impressions. The goal is to improve the morality of a lawyer’s conduct and emphasize that the lawyer must be fully prepared - knowing the case theory, the facts, the documents, and prior witness statements. The discussion also highlights the ethical responsibilities outlined in the Model Rules of Professional Conduct.
