This episode of the Deep Dive we dive into the latest RICO suit filed in the ongoing battle against insurance fraud. Filed in the United States District Court for the Eastern District of New York by Merchants Mutual Insurance Company against numerous defendants, including law firms, medical practices, and individual doctors. This civil action, brought under the Racketeer Influenced and Corrupt Organizations Act (RICO), alleges that the defendants participated in a large-scale "Fraud Scheme" operating since at least 2018. The core allegation is that the defendants formed an "association-in-fact enterprise" to recruit claimants, stage accidents, use confederate medical providers to provide unnecessary and costly healthcare services (including surgeries), and then file fraudulent lawsuits to extort money from the insurance company through inflated settlements. The complaint provides detailed case studies of four claimants to illustrate the pattern of racketeering activity, which includes mail fraud, wire fraud, Travel Act violations, and Hobbs Act violations, and seeks trebled damages, fees, and injunctive relief against the accused parties.
