The provisions of Part IX of the Indian Constitution that were bought in by the 73rd amendment 1992 were not automatically applicable to the fifth schedule areas which are found in 10 states named Andhra Pradesh, Telangana, Chhatisgarh, Gujarat, Himachal Pradesh, Jharkhand, Madhya Pradesh, Maharashtra, Odisha and Rajasthan. So now PESA 1996 comes into picture. PESA Act or the Extension Act also known as “Provisions of the Panchayats (Extension to the Scheduled Areas) Act”, 1996 extended the application of the Ninth Part of Indian Constitution to Fifth Schedule Areas of the Indian Constitution in the above mentioned 10 states.
