Pakistan’s National Commission for Minorities Bill: What Really Happened in Parliament?

We trace the issue from its origins in 2014, when Justice (R) Tassaduq Hussain Jillani advised the government—through the Supreme Court—to establish a statutory commission for minority rights. Although a commission was formed in 2015, it functioned only as a consultative body without real authority.

In 2021, the Khyber Pakhtunkhwa Assembly passed a resolution urging that a legally empowered National Commission be established as directed by the Supreme Court. Progress continued in 2023, when the then Federal Minister for Religious Affairs, Mufti Abdul Shakoor (late), presented a bill in the National Assembly. That bill contained 32 clauses and was forwarded to the parliamentary committee for review.

After the change of government, the bill resurfaced in Parliament on 2 December, but with some new elements. One of the most debated clauses stated that decisions of the new National Commission for Minorities would hold supremacy over all previous Pakistani laws, and could potentially render earlier legislation “ineffective.”

Religious parties strongly objected to this clause. Leaders such as Maulana Fazlur Rehman, PTI’s Barrister Gohar, and PPP’s Abdul Qadir Patel argued that this clause could be misused, potentially creating a “backdoor” opportunity for individuals or groups previously affected by constitutional or judicial decisions to challenge those rulings. They also insisted that such a clause might weaken foundational constitutional provisions, including those related to Khatm-e-Nabuwwat (Finality of Prophethood).

Following this debate, the controversial clause was removed.
The newly formed National Commission for Minorities will now function as a recommendatory and advisory body. It will address minority rights, present suggestions to the government, and promote legal protection, but it will not override existing laws.
