The right to life is enshrined in the South African constitution which, through the Bill of rights, entrenches all human rights. But this was not always the case. On the 15th of February 1995, eleven judges of the Constitutional Court heard their first case on the constitutionality of the death penalty.
The matter, relating to the State versus Makwanyane case raised important issues about the constitutional guarantees of the right to right life. As we continue our commemoration of 30 years of democracy, Nadia Dambuza revisits the matter through the case of the Sharpeville 6 who were sentenced to death in 1985.
