The child custody process in India involves several steps, including:
Filing a petition
A parent can file a petition with the Family Court or the court where the child lives. The petition must include the child's details, the reasons for the petition, and the other parent's details.
Mediation
The court may refer the parties to mediation before the hearing to try to reach an agreement.
Court hearing
If an agreement isn't reached, the court will hold a hearing where both parties can present their case and evidence.
Decision
The court will consider the child's best interests, including their age, health, education, and welfare. The court will also consider the parents' financial and social status. The court will then issue a custody order that specifies the custody arrangement, visitation schedule, and other conditions.
Enforcement
Both parents are legally obligated to comply with the court order. If they don't, the court can take enforcement action.
Modification
The custody order can be modified if there's a significant change in circumstances.
