VERDICT REACHED: Drugged Husband Murder Trial — FL v. Herbert Swilley — Day 5

Fifty-five-year-old Florida man Herbert Swilley is facing a first-degree murder charge in the death of his husband, Timothy Floyd Smith, who investigators believe was drugged, assaulted, and strangled before his body was staged to resemble a false crime scene. The couple had been married for nearly eight years when Smith was found dead inside their Ocala apartment in March 2023 after failing to show up for work. Investigators later determined that Smith had been given an extremely high dose of diphenhydramine — the active ingredient in allergy medications — at a level 30 times higher than the normal therapeutic amount. Prosecutors allege that Swilley then strangled his husband and fractured his cervical spine. Swilley could face life behind bars if found guilty for his husband's murder
