सुप्रीम कोर्ट ने एक ऐतिहासिक और महत्वपूर्ण फैसले में स्पष्ट किया है कि केवल अपराधिक मामला लंबित होने के आधार पर किसी व्यक्ति के पासपोर्ट के नवीनीकरण (Renewal) से इनकार नहीं किया जा सकता।
माननीय न्यायालय ने कहा कि पासपोर्ट प्राप्त करना और उसका नवीनीकरण कराना व्यक्ति का मौलिक अधिकार है,
जो कि संविधान के अनुच्छेद 21 (जीवन और व्यक्तिगत स्वतंत्रता का अधिकार) के अंतर्गत संरक्षित है।
जब तक किसी सक्षम न्यायालय द्वारा यात्रा पर स्पष्ट प्रतिबंध न लगाया गया हो, तब तक सरकार या पासपोर्ट अथॉरिटी पासपोर्ट रिन्यूअल से मना नहीं कर सकती।

In a historic and significant judgment, the Supreme Court has clearly held that a person’s passport renewal cannot be denied merely on the ground that a criminal case is pending against them.
The Hon’ble Court observed that obtaining a passport and getting it renewed is a fundamental right, which is protected under Article 21 of the Constitution (Right to Life and Personal Liberty).
Unless a competent court has specifically imposed restrictions on travel, the government or the passport authority cannot refuse passport renewal.
