Justice Department Publishes List of Sanctuary Jurisdictions https://www.justice.gov/opa/pr/justic...
In December 2022, Congress approved $75 million in funding for the U.S. Department of Housing and Urban Development (HUD) to support the creation of new permanent supportive housing. The funds were allocated under the Continuum of Care (CoC) program for new construction, acquisition, or rehabilitation.
However, the distribution of this funding has since become entangled in political and legal disputes. Here is a timeline of events surrounding the $75 million appropriation:
Late 2024: The Biden administration concluded an application process for this and other CoC funding but did not announce award winners before leaving office.
August 2025: The new administration notified members of Congress of grant winners based on the prior competition but did not publicly announce the awards.
September 5, 2025: HUD, now led by Scott Turner, announced a new, politically-motivated grant application process with different eligibility requirements.
September 11, 2025: A lawsuit was filed against HUD by nonprofits, including the National Alliance to End Homelessness, claiming that the new criteria unlawfully weaponized federal funding for political reasons.
September 12, 2025: A federal judge temporarily blocked HUD from enforcing the new conditions, which were linked to the administration's policies on immigration and transgender rights.
As of September 2025, the original $75 million, which was designated for fiscal year 2023, has still not been awarded and is set to expire by the end of the month.
In addition to the $75 million, there was a similar situation with $100 million in CoC funding from fiscal year 2024, which also remains undistributed. The total amount of undistributed funds intended for new permanent supportive housing is $175 million.
“Sanctuary policies impede law enforcement and put American citizens at risk by design,” said Attorney General Pamela Bondi. “The Department of Justice will continue bringing litigation against sanctuary jurisdictions and work closely with the Department of Homeland Security to eradicate these harmful policies around the country.”
On April 28, 2025, President Trump signed Executive Order 14287: Protecting American Communities from Criminal Aliens. The Executive Order recognized that “some State and local officials . . . continue to use their authority to violate, obstruct, and defy the enforcement of Federal immigration laws” and “[i]t is imperative that the Federal Government restore the enforcement of United States law.” The Executive Order directed the Justice Department, in collaboration with the Department of Homeland Security, to publish a list of such jurisdictions. Accordingly, the following states, cities, and counties have been identified as sanctuary jurisdictions:
