Between section 504 of the Rehabilitation Act, Title II of the Americans with Disabilities Act (ADA), the Individuals with Disabilities Education Act (IDEA), Federal Motor Vehicle Safety Standard (FMVSS) 403 for platform lifts and 404 for their installation, 49 CFR 37 and 38, explicity 49 CFR 37.165(g), 17 NYCRR 720.8(b)(8)(viii) School buses transporting disabled persons are explicitly required to be accessible (meet or exceed ADA accessibility guidelines (ADAAG) for transportation). Accessible school bus transportation is a federal and NY state protected civil right. Accessible school buses are designed and mandated by motor vehicle safely and accessibility regulations to accommodate anyone who has difficulty boarding normally for any reason, standees, those who use walkers, crutches or other mobility devices including wheelchairs facing inboard or outboard.
