If you've been charged with drug possession it's important to fully understand what the charge involves, so that you can effectively fight the matter or increase your chances of avoiding a conviction altogether. If you wish to plead guilty. Drug possession refers to situations where drugs are in your custody or control, and where they are intended for your own personal use. This is different to the charge of supply, which involves the distribution of drugs to other people, and can result in harsher penalties. Situations where you may be charged with drug possession include where you know you've got your drugs in your home, or in your car, or where you were carrying them in your pocket, on your body, or in your belongings, or where you've stashed them, or gotten rid of them after being seen by police. You don't actually have to own the drugs to be charged with possession. It is enough that you knew, or should have known that you had them. That means that drug possession can include situations where you're just holding onto drugs for someone else. However, drug position won't include situations where you weren't aware and could not reasonably have been aware the drugs had been planted on you, or where you realised that drugs had been planted on you and you took immediate steps to get rid of them.
