An Allen Hearing is a court proceeding in Oklahoma that is held in criminal cases to ensure that the prosecution has turned over all relevant evidence to the defense. It is a way for the defense to find out what evidence the prosecution has and to identify any potential surprises or issues, such as exculpatory evidence (evidence that may prove the defendant is not guilty) or issues with the credibility of witnesses. During the hearing, the prosecution and defense will announce whether they have received all the evidence they are entitled to and if any issues need to be addressed. If there are any issues, the court may schedule a second Allen Hearing to address them. The purpose of an Allen Hearing is to ensure fairness in the criminal trial process and to avoid trial by ambush.
