The West Pakistan Probation of Offenders Rules, 1961 were established to implement the provisions of the Probation of Offenders Ordinance, 1960. These rules provide the framework for the administration and supervision of offenders who are released on probation instead of being sentenced to prison. 

Key aspects of the rules include:

Administration: The rules established the Probation Department in West Pakistan, led by a Director of Reclamation and Probation (or an "Officer-in-Charge") who is responsible for overall control and supervision.

Probation Officers: The rules detail the appointment, qualifications, and duties of probation officers. A probation officer is responsible for supervising, advising, and assisting offenders placed under their charge by a court. They are required to submit reports to the court on the probationer's conduct.

Case Committees: To assist in the probation process, a Case Committee is established for each district. The committee is headed by the District Magistrate and includes probation officers and other magistrates. It serves as an advisory body on probation work within its jurisdiction.

Probation Orders and Bonds: The rules prescribe the forms for probation orders and the bonds that offenders must execute. Conditions for probation orders can be tailored to the individual offender and may relate to residence, abstaining from intoxicants, and other matters deemed necessary by the court.

Conditional Discharge: The Ordinance and rules provide for conditional discharge, where an offender may be released with an admonition or on the condition that they enter into a bond for a period of up to one year.

Breach of Probation: The rules establish the procedure for handling a probationer who fails to observe the conditions of their bond. This may result in the court issuing an arrest warrant or summons and, after a hearing, sentencing the offender for the original offense.

Effects of Probation: A significant feature is that a conviction resulting in a probation order is generally not considered a conviction for other purposes, such as imposing a legal disqualification or disability. This allows the offender a fresh start. 

Modern context

Though the Probation of Offenders Ordinance, 1960 and its rules were established in the former West Pakistan, they remain largely in force today throughout Pakistan. Some provinces, like Punjab, have passed supplementary legislation, such as the Punjab Probation and Parole Service Act 2019, to further refine and modernize the system. However, the 1960 Ordinance and its rules form the core legal framework for probation in the country.
