In this video, we are going to talk about how to obtain letters testamentary. I'm Sarah Siedentopf. I'm an estate planning and probate attorney in Atlanta, Georgia. So, letters testamentary, what is it? So, letters testamentary, what is it? When are you likely to run into it, and how do you get it? So what letters testamentary is, is the order from a probate judge appointing the executor of an estate. So in general terms, that's what it is. When are you likely to realize that you need it? Someone has passed away, and you go to perhaps talk to the mortgage company, or try to deal with a bank account, something like that. And you receive a request for letters testamentary proving that you are the person who should be talking to them. So that is likely why you are looking for letters testamentary. And the way you get it is going through probate. So the probate process involves filing a petition to probate the will. You've gotta have all the heirs sign it. You've got to notify people. The judge will look at the will, and once any questions about that are answered, will issue those letters testamentary. There's a similar format for if there was not a will that, in that case, it's letters of administration, but it's basically the same process in that you are starting probate, and that is the initial order from the judge allowing you to act for the estate. But that is how you get letters testamentary is going through the probate process. Filing that petition to probate along with the original will answering any questions that the court has. Then the judge will issue that order called letters of administration.
