If the Appeals Council does not rule in our favor, that the judge made a mistake, then we look at the Appeals Council's decision again, look at the judge's errors, find out if the judge has made legal errors. The burden of winning a case in federal court is much more difficult and we scour the case for legal errors that will be winnable errors in federal court.
We do take a number of cases to federal court but we are much more selective and make sure that we can make good, cogent legal arguments in federal court. The option is to re-apply with the case starting the day after the administrative law judge's denials. Sometimes that's much better.
