DEED OF SALE pero TAX DECLARATION lang hawak, safe ba ito? Tax Declaration Certificate but no TCT

Pwede ba bumili ng real property na tax declaration lamang ang hawak ng seller?

Safe bang bumili ng Property kahit tax declaration lang ang hawak?
NO & YES!!!
What is Tax Declaration?
Scenario:
a. Mother Title with several Tax Declaration
b. No Title or unregistered land

How to mitigate risk?
Kailangan natin mag due diligence
Yong may title na nga need due diligence lalo pa pag walang title
Ito mga kailangan natin gawin:
1. Actual Inspection of the property:
a. Kapag sinabi ng seller na meron Check Boundaries (Mohon), Fence (Bakod), Tress (puno) or bahay (kubo) pero during actual visit ay wala red flag yan.
b. Interview care taker of the property
c. Ask neighbors as to the history of the property.
d. If agricultural land, check with DAR if kong may claim.


2. Check if owner legit and existing, Iwasan makipag deal kapag SPA lamang. Huwag pumayag na hindi makita at ma verify ang owner ng property nakalagay sa Tax Declaration.

3. Go to assessors office using copy of tax declaration trace mo pinangalingan ng lupa pano ito nalipat sa mga dating owners.

4. Check tax declaration (2 kinds)
a. Tax Declaration for Lot or land
b. Tax Declaration for House or Improvements

5. Check sa Assessors office kong updated ang Real Property Tax or Amiliar

6. Check kong marami nakapangalan sa Tax Declaration at check din if namatay na me ari ng lupa
Ito ay dadaan sa Estate Tax pirpirma mga tagapag mana

7. If ok na lahat. Ipa survery ang property sa isang License Geodetic Engineer. Para malaman ang boundaries and subdivision nito. Kelangan morin ang survery para sa pag ppatitulo nito sa registry of deeds.
Note: technical description na gawa ng geodetic engeneer ay ito rin ilalagay sa Deed Of Sale at sa magiging Title ninyo.

8. NEGOTIATE: 50% Down payment at 50% upon release of Title under your name.
Note:
a. Notice in Barangay where the property is situated to allow anyone who contest on the selling of real property.
b. DENR restriction in cutting trees, if you plan to cut trees.
c. Buying agricultural land need clearance from DAR.
