Mr. Figueroa elaborates on the "Pinkerton's Doctrine," which holds defendants accountable for all foreseeable crimes committed by co-conspirators during a conspiracy, regardless of intent.
Defenses to crimes charged under this doctrine exist, however, if the crimes committed are not a foreseeable consequence, no culpability will apply.
Consider the scenario in which Lamont and Jonathan conspire to commit grand larceny at Best Buy. While waiting for Jonathan, Lamont kicks a dog and is charged with animal abuse. Jonathan will not be held culpable for animal abuse, as it is not reasonably foreseeable as a consequence of grand larceny.
If you are facing formal charges of conspiracy and other crimes connected to that conspiracy, please reach out to Mr. Figueroa to book your first free consultation. #attorneyatlaw #nevada #conspiracy #lawfirm #criminalcase #criminaldefense
