What is adverse possession?
The concept of adverse possession stems from the idea that land must not be left vacant but instead, be put to judicious use. Essentially, adverse possession refers to the hostile possession of property, which must be “continuous, uninterrupted, and peaceful.”
Adverse possession occurs when the owner of a property fails to remove the trespasser within a statutory period, resulting in the owner losing the legal ownership rights. As soon as the statutory limitation period for eviction expires, the true owner cannot pursue legal action to repossess the property, and the trespasser acquires it by adverse possession or hostile possession
According to the Law Commission’s report, the rationale behind this comes from considerations that the “title to land should not long be in doubt”, “society will benefit from someone making use of land the owner leaves idle,” and “persons who come to regard the occupant as owner may be protected.”
What is the statutory period of adverse possession?
The statutory period of limitation for possession of immovable property or any interest therein, as stipulated in Section 65 of the Limitation Act, 1963, is 12 years in the case of private property. However, the apex court has maintained that illegal occupancy of a government property does not fall under the purview of the latest judgement. Hence, the occupant does not become the owner of the property if the unit in question is government’s and has been illegally inhabited. It is important to note that in certain cases, the limitation period is suspended and is not considered for the calculation of the statutory period. This happens in situations when there is pending litigation between the claimant and the owner over the same property; or where the owner is of unsound mind or 'minor' or where the owner is serving in the armed services, among others.
In order to file a claim, the claimant must occupy the property during its full statutory limitation period. If so happens, by adverse possession against the rightful owner, the trespasser gains the title to the property.
