All involved in mediation must handle not only their own cognitive biases but also those evidenced by the comments and actions of others. Are people allowing an initial reference point or anchor to distort their decisions? Are you, or others taking part in the negotiations, too confident about your abilities in relation to everyone else's? Perhaps the parties have fallen into the "sunk-costs trap." Or maybe confirmation bias is at work; some are relying on information that confirms existing views and downplaying contrary information.

Mediators Howard Marsee and Ana Cristina Maldonado presented "Recognizing and Dealing With Cognitive Biases in Negotiation" on June 23, 2021, explaining how these and other faulty perceptions can cloud or slow negotiations. From years of experience in their mediation practices, the presenters will offer their best advice on how to proceed when it becomes apparent that cognitive biases are impeding your mediation.

The Florida Bar has accredited this Webinar for 1.5 hours of general Continuing Legal Education (CLE) credit.
