🌍 Key Changes to open work permits for family members of temporary residents 🇨🇦
As part of the measures announced in September 2024, IRCC is introducing significant changes to eligibility for family members of international students and foreign workers, effective January 21, 2025, at 5:00 UTC.
Here’s what you need to know:
🎓 For Spouses of International Students: Eligible for OWP if the principal applicant is enrolled in:
✔️ Master’s programs lasting 16 months or longer
✔️ Doctoral programs
✔️ Select professional and eligible programs
💼 For Spouses of Foreign Workers: Eligible for OWP if the principal applicant is employed in:
✔️ TEER 0 or 1 occupations
✔️ Select TEER 2 or 3 occupations in sectors with labour shortages or aligned with government priorities, such as natural and applied sciences, health care, education, and construction. The full list will be available on January 21, 2025.
➡️ Note: The foreign worker must also have at least 16 months remaining on their work permit at the time when their spouse applies for the OWP.
🚫 What’s Changing?
✔️ Dependent children of foreign workers are no longer eligible.
✔️ Approved OWPs under the previous criteria will remain valid.
📅 Applications Before January 21, 2025: If you apply before January 21, 2025:
✔️ Applications received before this date will be processed under the previous eligibility criteria.
✔️ Approved OWPs will remain valid as long as they haven’t expired.
➡️ IRCC will continue to process all applications submitted before January 21, 2025.
🔄 Renewals
Family members can apply to renew their work permit if:
✔️ They are applying under the same criteria as the current work permit, and
✔️ The requested duration of the renewal matches that of the existing study or work permit of the principal applicant
✨ Exemptions
Spouses of workers covered by free-trade agreements and those transitioning to permanent residence will not be impacted.
💡 Additional Options
Family members who no longer qualify can explore other work permit pathways under Canada’s work permit programs.
