About the Speaker:

Jarlath Spellman is the National Member for Ireland at Eurojust based in the Hague. He was called to the Irish Bar in 1992. He then worked as Advisory Counsel at the Office of the Attorney General in the area of Justice and Home Affairs. In 2001, he was appointed a Professional Officer at the Office of the Director of Public Prosecutions. He has had experience in the prosecution of a wide range of serious criminal offences as well as dealing with mutual legal assistance and extradition.

About the Speech:

Mr. Jarlath Spellman spoke about the European Evidence Warrant (EEW), as approved in December 2008, in the context of the Eurojust experience of the use of other existing mutual recognition instruments including the European Arrest Warrant and the Framework Decision on freezing orders amongst others. The implementation period for the EEW will end in January 2011. Issues highlighted included the practical difficulties associated with mutual recognition instruments; whether the law on mutual recognition is robust enough; the exclusion of certain evidence under the EEW and whether there is a need for these exclusions to be removed; and the concern that the effect of the EEW may be limited if there are issues surrounding the admissibility of evidence.
