This hearing will determine whether key evidence — including everything from the backpack search — will be allowed at trial. Since there was no warrant, the prosecution has to present an “exception” to justify the search to the judge. The “exigent circumstances” exception likely won’t apply, so prosecutors must prove they had probable cause BEFORE the search, independent of the backpack’s contents to justify a “search incident to arrest” exception.
That means the case may turn on:
• Nationwide BOLO photo match
• Use of a fake ID
• Officers’ articulable facts at the moment of arrest
If the defense wins suppression, it would gut the prosecution’s case, which is why the State is calling 28 witnesses — a rare but telling move.
