When You Realize You Accidentally Shot At The Police

On April 30, 2022, an officer with the Florida Fish and Wildlife Conservation Commission (FWC), Division of Law Enforcement, was on duty and in uniform, conducting State Law Enforcement patrol in Collier County, Florida.
At approximately 2230 hours, the officer was in a concealed position at Sabal Palm Road and the hiking trailhead in the Picayune Strand State Forest when several shots were heard coming from the Oberlin Trail south of Sabal Palm Road. It is relevant to note that the shots were being fired in the officer’s direction. For a moment, there was concern about being struck by a stray bullet. The shots were close enough that the distinct whistling noise of bullets passing nearby could be heard. The officer moved from the location to investigate.
Upon arrival, two males were observed standing next to a vehicle, shooting at one of the forest’s signs.
One of the subjects was holding the firearm upon the officer’s arrival. The emergency blue lights and siren were activated on the marked patrol vehicle. Both subjects looked back and immediately fled into the woods, with the armed subject running while holding the gun.
The officer immediately called for assistance via radio, backed up the patrol vehicle, and assumed a tactical position. Using the loudspeaker, repeated verbal commands were given for the subjects to exit the woods with their hands up. After several minutes, both subjects complied and emerged from the woods, where they were placed under arrest. They were patted down for weapons, and handcuffs were double-locked.
Two additional FWC officers arrived on the scene to assist. The officer then read both subjects their Miranda rights from an agency-issued text, and both agreed to speak. When asked about the firearm, the armed subject stated that the gun had been tossed into the woods while fleeing. The subject pointed in the general vicinity where it was discarded, and another officer located the firearm. The gun, a 9mm goost pistol, was made safe, as it was found loaded with a live round in the chamber. When asked who had fired the gun, the armed subject admitted to shooting, confirming the officer’s initial observations.
A search of the vehicle incident to arrest yielded no significant findings. However, one half-consumed liquor bottle was found in the back seat, two open cans of beer were located in the center console, and a small amount of marijuana was discovered in the driver’s door. The vehicle was towed by a rotational tow company.
Both subjects were transported and booked into the Naples Jail Center. One cellphone was left in the jail property for the armed subject. A cellphone, a wallet containing a Florida driver’s license, and a credit card were left in the jail property for the second subject.
The 9mm ghost pistol, along with recovered live and spent 9mm casings, was submitted into evidence at the FWC Naples Field Office evidence compound.

• F.S. 790.15(1): Discharging a firearm in a public place
