Cybercrime Prevention Act of 2012 (RA 10175)
Since the act involves the use of the internet (uploading), the Cybercrime Prevention Act is often applied in conjunction with RA 9995.
Penalty Hike: Under Section 6 of this law, if a crime defined in the Revised Penal Code or special laws (like RA 9995) is committed through information and communication technologies, the penalty is increased by one degree.
Consequence: This could effectively raise the potential prison sentence to significantly higher terms (often cited up to 12 years).
Safe Spaces Act (RA 11313)
Also known as the "Bawal Bastos Law," this act covers Gender-Based Online Sexual Harassment.
The Act: It penalizes the uploading or sharing of any forms of media that contain photos, voice, or video of a victim’s "private parts" or "sexual acts" without consent.
Penalties: Fines between ₱100,000 and ₱500,000 and imprisonment of 2 to 4 years.
Anti-Violence Against Women and Their Children Act (RA 9262)
If the parties are in a dating or romantic relationship, the act of uploading the video can be classified as Psychological Violence.
The Act: Disseminating intimate materials to humiliate or control a partner causes "mental or emotional anguish."
Consequence: Lean de Guzman could apply for a Protection Order (TPO/PPO) to compel the immediate removal of the content and prevent Vinz from contacting or further harassing her.
