Jon Lopez rear-ended a freightliner truck causing his death. Lopez’s estate filed a lawsuit against the truck driver and the owner of the truck, Wilsonart, claiming the truck driver was partially at fault. The parties presented conflicting evidence between video evidence and eyewitness testimony. The trial court granted summary judgment in favor of Wilsonart. On appeal, the Fifth District Court of Appeal reversed the trial court ruling and certified a question of great public importance to this Court.
