The ADM Jabalpur vs Shivkant Shukla (1976) case, popularly known as the Habeas Corpus Case, is one of the most controversial and historic judgements in India’s constitutional history.
During the Emergency of 1975, the Supreme Court had to decide whether citizens could challenge their detention when Fundamental Rights (Article 21) were suspended.
