In the first case, Charles Newman appeared for sentencing in Cause Number 25-DCCR0545 after previously pleading guilty to a second-degree felony charge of aggravated assault with a deadly weapon. The court reviewed the pre-sentence investigation report and addressed restitution in the amount of $1,653.75, which both parties agreed upon. However, the hearing took a serious turn when Mr. Newman tested positive for THC on the morning of sentencing. Judge West expressed strong concern, emphasizing that this showed a lack of responsibility, especially given the gravity of the offense.
Judge West sternly reminded Mr. Newman that he had fired a weapon at another vehicle on the interstate, narrowly missing innocent people simply because he was angry after being cut off. Despite arguments from the defense that the incident was out of character and that Mr. Newman had stable employment and no prior criminal history, Judge West made it clear that the conduct was extremely dangerous.
Ultimately, Judge West honored the plea agreement and placed Mr. Newman on 10 years of deferred probation, ordered a $1,000 fine, restitution, completion of the JCDI treatment program, use of a drug patch, and 15 days in the Jefferson County Jail. Judge West stressed that any violation could result in up to 20 years in prison, while successful completion would lead to dismissal of the case.
In the second matter, Isaac Mitchell pleaded guilty to a Class A misdemeanor assault family violence charge. Judge West accepted the plea, ordered a pre-sentence investigation, modified bond conditions to remove GPS monitoring and no-contact restrictions, and strictly prohibited firearm possession. Judge West emphasized rehabilitation, family stability, and preventing future violence before resetting the case for sentencing.
