In this video our legal expert Adv. Naman Mohnot has explained the facts of landmark judgment namely Maunish Dinkar Shaw vs State Of Gujarat.
The high court held that father being a natural and lawful guardian, removal by him of his son below 5 years of age from his mother is not an offence under Section 361. In the result, therefore, it is obvious that, even if all the allegations made in the FIR are held to be true and accepted in its entirety, no offence under Section 363 of the Indian Penal Code and Section 452 of the Indian Penal Code are made out against the applicants.
