In July, 11 people were stabbed at the Traverse City Walmart.
One of the victims, Aaron Boudot, has has hired the legal firm Morgan and Morgan to file a lawsuit against Walmart and the accused attacker, Bradford Gille, calling for changes in store policies and procedures.
Boudot's attorneys argue that the tragedy was preventable and claim Walmart's negligence was evident during the 33 minutes before the first stabbing.
"This was totally preventable by Walmart. They just needed to make a call," said Nicholas Panagakis, one of the attorneys representing Boudot. "We intend to hold Walmart accountable for putting policy manuals on shelves while leaving customers unprotected on their floors."
David Stechow, another attorney for Boudot, stated, "The reason that this lawsuit was filed and the reason that we are all here today is because Walmart has refused to take any responsibility for their negligence."
They claim that negligence was evident for 33 minutes on that July day.
"Now during those 33 minutes, between the time he walked in at 4.10 and the first stabbing at 4.43, numerous customers observed Gille acting suspiciously, never focusing on doing any shopping. He had no basket. He had no cart," Stechow said.
The lawsuit alleges that Walmart failed to act on suspicious behavior exhibited by Gille, who was seen loitering with a large backpack, a red flag according to Walmart's own rules.
