In Indian law, consumer protection is primarily governed by the Consumer Protection Act, 2019, which replaced the 1986 Act. This Act, and other specific laws like the Sale of Goods Act, 1930, provide consumers with several key rights and a dedicated system for seeking redressal against unfair trade practices and exploitation.
The Consumer Protection Act, 2019, guarantees six fundamental consumer rights: right to safety, right to be informed, right to choose, right to be heard, right to seek redressal, and right to consumer education. These rights aim to protect consumers from hazardous goods, ensure they have access to information and choices, allow their concerns to be considered, provide avenues for remedy against unfair practices, and empower them with knowledge. The Act establishes a three-tier quasi-judicial system for handling consumer grievances:
District Consumer Disputes Redressal Commission (DCDRC): For claims up to ₹50 lakh.
State Consumer Disputes Redressal Commission (SCDRC): For claims over ₹50 lakh and less than ₹2 crore.
National Consumer Disputes Redressal Commission (NCDRC): For claims exceeding ₹2 crore.
Consumers can file complaints online via the National Consumer Helpline portal or the e-Jagriti platform. Generally, complaints must be filed within two years of the cause of action.
