On October 15, 2023 shortly after 12:00 AM, Officer Luv St. Andre with the Pullman Police Department observed a 2014 Toyota Tacoma driving without headlights in the vicinity of NE Colorado Street and NE Opal Street. He followed the vehicle and eventually initiated a traffic stop at 305 N Grand Avenue in front of Timber. He proceeded to make contact with the driver, who was identified as 20-year-old Laura.
After he made contact with Laura, asked her if she knew why she was being stopped and where she was coming from. Laura told the officer that she was transporting 2 unidentified females that she had met at Domino’s because she was sober. Officer St. Andre noticed that Laura’s eyes indicated signs of impairment and he asked her how much she had been drinking. Laura initially said she had not consumed any alcohol but later admitted to drinking about 6-8 hours earlier that day. Based on his suspicion of impairment, Officer St. Andre asked Laura to exit the vehicle and offered her an opportunity to participate in field sobriety exercises.
The first exercise was the Horizontal Gaze Nystagmus (HGN) test, and Officer St. Andre observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and vertical nystagmus in both eyes. The second exercise was the Walk and Turn test. During the Walk and Turn test, Laura did not make heel-to-toe contact on each step and turned improperly. The final exercise was the One Leg Stand test. During the One Leg Stand test, Laura hopped twice and displayed a lack of balance.
Following the field sobriety exercises, Officer St. Andre offered Laura an opportunity to take a Preliminary Breath Test (PBT). The results of the PBT indicated that Laura’s BAC was at 0.120%, which was over the legal limit of 0.08%. Based on her inability to perform the field sobriety exercises and the results of the PBT, Officer St. Andre placed Laura under arrest for driving under the influence. She was not handcuffed because she had a cast on her right arm. Laura was placed in the patrol car and transported to the Pullman Police Department for further processing.
Once they were at police HQ, a search of her wallet yielded 3 fictitious driver’s licenses. Officer St. Andre advised Laura of her Constitutional rights, and Laura agreed to waive them and answer questions. He also read the Implied Consent Warning to her, and she agreed to submit breath samples for testing after consulting with an attorney. Laura’s Alcotest results indicated a BAC of 0.116% (lowest IR result).
After Officer St. Andre was finished with administering the breathalyzer, he placed Laura in a cell. Following a brief holding period, Laura was removed from the cell to be photographed and fingerprinted. Officer St. Andre cited Laura under RCW 46.61.502 for 1 count of driving under the influence under RCW 46.20.0921.1A for 3 counts of displaying or possessing a fraudulent license. After issuing her the citations, Laura was released pending her court appearance.
